Terms of Service Overview:
Excell Digital grants clients the right to use property images for promotional purposes, including marketing the property and showcasing their services, until the property is sold or withdrawn from the market. However, Excell Digital retains full ownership of all images and content unless a written agreement specifies otherwise. Images may not be distributed, resold, or repurposed for any other use without prior written permission.
Data Privacy
At Excell Digital, protecting your privacy is our priority. Any personal information you provide, such as your name, email, or phone number, will only be used for internal purposes and occasional marketing updates. We never sell or share your information with third parties. You’ll have the option to unsubscribe from communications at any time via the provided link.
Image Ownership
All photographs and digital materials created by Excell Digital are protected under copyright law, and the company retains sole ownership of these assets.
Excell Digital grants clients a limited, non-transferable license to use the photos for property-related marketing while the listing is active. This includes advertising the property or promoting the client’s business. The license expires when the property is sold or no longer listed unless otherwise agreed in writing.
Photos may be shared with the client’s parent organization to assist with marketing the specific property but may not be used by third parties such as builders, designers, or publishers without Excell Digital’s express written consent.
Independent Business Relationship
Excell Digital operates as an independent contractor and is not an employee or partner of the client. This agreement does not create a partnership, joint venture, or employment relationship between the parties. Neither party may act as an agent or bind the other except as explicitly agreed upon in writing.
Deliverables provided by Excell Digital, including all images, are not classified as “works for hire” under copyright law. Usage rights are granted solely as outlined in this agreement and are contractual in nature.
